What is a tort?

Tort law is the basis of personal injury cases, and involves instances in which a person’s negligence or recklessness injures another person. In order for a person to have a chance at winning a personal injury lawsuit, that person’s case must meet the following four elements of a tort:

  1. The plaintiff owed some duty to the defendant
  2. The defendant breached or broke that duty
  3. The plaintiff suffered an injury
  4. The plaintiff’s injury was the direct result of the defendant breaking his or her duty
