California woman receives $22 million from malpractice lawsuit

In 2006, a woman entered the Palo Alto Medical Foundation in California in order to seek treatment for her chronic migraines. She had been a patient for several years, and only underwent non-invasive procedures. Doctors decided to perform an angiogram on the woman.
The patient was unaware of the risks associated with this procedure, and was also not aware of the fact that this was a highly invasive procedure. Doctors injected a colored dye into a blood vessel in the woman’s brain, and, almost immediately, she fell into a coma. She remained in a coma for approximately two weeks. Once she awoke, she was classified as a quadriplegic.
The woman needs constant care and attention every single day of the year. Her medical costs reach up to $350,000 a year. She is confined to a wheelchair, and her speech has slowed. The jury in her case awarded her $22 million in damages.

Florida gastric bypass patient wins $178 million in lawsuit

Last week, a jury in Northeast Florida awarded a gastric bypass patient $168 million in a lawsuit filed against the biggest for-profit hospital operator in the U.S.–HCA Holdings Inc. The plaintiff had surgery at one of HCA’s hospitals, Memorial Hospital in Jacksonville, in 2007.
The jury determined that the hospital and the doctor who performed the plaintiff’s surgery were negligent in failing to diagnose or treat complications experienced by the plaintiff after his gastric bypass procedure in a timely manner. In addition, the jury found that the hospital had made fraudulent misrepresentations about the surgeon and his qualifications.
The patient became confined to a wheel chair and lost his hearing and vision as a result of the delays in diagnosis and treatment. On Monday, the jury added $10 million in punitive damages to the patient’s award.

Woman indicted on charges from fatal dog attack

Deanna Blitch, 51, was indicted on charges including attack by a dangerous dog and lying to deputies regarding the mauling from a fatal dog attack on June 10 near Hawthorne that killed 74 year old Roy McSweeney.
William Braxton Blitch, 26, son of Deanna, was also indicted on charges of resisting an officer without violence and providing false information to law enforcement.
McSweeney was working in his yard next door to the Blitch’s home when her Pitbull mix attacked him without provocation resulting in him losing one arm, severely injuring the second arm, and injuring his face. McSweeney died of injuries days later.

New Florida state laws to go into affect over weekend

Multiple new laws are set to go into affect on Saturday and they cover everything from gun control to abortion.
One new law that starts Saturday now allows firearms to be carried into public places such as parks and buildings. Another law that will take place this weekend will make it more difficult for juvenile girls to receive the parental notification waivers that are needed in order to get an abortion.
Other laws include laws that will aim to cut back on medical malpractice lawsuits and having outlawing sex with animals.
